Reading the land register: which entries matter for valuation?

The land register helps establish the subject of valuation, ownership shares and registered rights and encumbrances. The supporting deed is often decisive because a brief entry does not fully explain the precise content. A registered mortgage amount is not evidence of the current loan debt. Read the extract as the starting point for a targeted review and supplement it with agreements, building documents and, where appropriate, cadastral information.

AT A GLANCE
  • The cadastral municipality and folio number identify the register folio; plot numbers define its contents.
  • For a right or encumbrance, its scope, affected share and underlying deed must be checked.
  • The land register, actual use, existing buildings and current debt balances answer different questions.

Start with the correct extract

Note the retrieval date, cadastral municipality and folio number. Then check the plot numbers and, for condominium ownership, the relevant unit and associated share. A street address alone is insufficient for clear identification. A visible garden or access route may belong to another plot recorded in a different folio.

The land register is a public register maintained by the district courts. For your working documents, you need a complete extract appropriate to the purpose. For a valuation at an earlier date, clarify which entries and deeds were relevant then. Label an older printout as historical information rather than using it uncritically as the current legal position.

Where to find each type of information

The following overview is a reading aid. For important entries, copy the item number and references to other sheets into your notes. This allows a professional to check the same passage quickly. The name of a right alone does not imply a particular deduction from value.

From the land register sheet to the valuation question
SectionTypical informationQuestion for the dossier
A1Plots belonging to the folioIs all the land being valued included?
A2Associated rights and certain restrictionsWhich entitlement or requirement affects use?
BOwners and sharesWhich unit or share is being valued?
CRegistered encumbrances and restrictionsIs the whole property or only a particular share affected?

The collection of deeds provides the substance behind the entry

The collection of deeds contains the documents on which entries were based. Use the reference in the extract to obtain the relevant document. For a right of way, for example, the geographical route and agreed use matter. For a right of residence, the affected rooms, beneficiaries, duration and cost provisions are relevant to further review.

Do not prematurely reduce the deed to a single word such as 'unproblematic'. Prepare a short list: affected area, content, missing attachment and specific question. If the agreement refers to a plan, that plan belongs in the review. Have unclear legal interpretations resolved; the valuation should then be based on a stated legal assumption.

What an encumbrance means for value and completion

Distinguish a restriction on use from a question of financing or completion. An existing right of residence may affect unrestricted use. For a mortgage, by contrast, particular attention is needed to the current obligation and whether and how discharge of the encumbrance is planned. The brief must state the legal circumstances under which the valuation is made.

Österreich.gv.at expressly points out that a mortgage entry in the land register says nothing about the current outstanding debt. Request appropriate evidence for that. Therefore do not automatically deduct the registered mortgage amount from a property value. An assumption that deletion is already secured also needs a basis; its requirements belong in the legal completion process.

Which documents must supplement the land register?

The extract is not a complete description of the inspected house. Also check actual use, tenancy or other occupancy arrangements and structural alterations. A structure recorded as a building does not, by itself, establish which rooms may legally be used as an apartment. The relevant building documents and assessments are needed for condition and approved construction.

Plot boundaries also require appropriate checking. According to BEV, boundaries in the boundary cadastre are legally binding, whereas the map in the land tax cadastre illustrates location. With inconsistent fences, unclear access or a boundary question relevant to value, the type of cadastre must therefore be considered and a surveying professional involved where necessary. A map extract does not answer every boundary question.

UNDERSTAND THE PRACTICE · FICTIONAL EXAMPLE

Synthetic example: share, right of way and mortgage

The following details are entirely invented and do not reproduce a real land register extract. An imagined folio contains a residential plot. Two people each own a half share. A right of way and a mortgage are also mentioned.

  1. First, the valuation brief establishes whether the subject is the entire property or a share considered individually.
  2. For the right of way, the affected plots and underlying deed, including its plan, are examined. The brief description alone explains neither route nor scope.
  3. For the mortgage, current evidence of the liability is required. The registered amount is not adopted as today's debt balance.
  4. The valuation states the assumed encumbrance position. A later asset or sale-proceeds calculation accounts for actual liabilities and completion costs separately.
What you can take away

The example provides three specific review tasks. It contains neither a legal interpretation of a real entry nor a blanket reduction in value.
