Checking land-use zoning and development provisions in Vienna

For land valuation, you need the current land-use zoning and development provisions, along with the status of a specific project. Vienna's online map provides a starting point; only the plan and text section show the relevant provisions. A building class or a marked building area does not establish approved living space. Therefore document every statement about use with its source location and have unresolved project questions examined specifically.

AT A GLANCE
  • Identify the plot by cadastral municipality and plot number before assigning planning symbols to it.
  • Assess the plan, general provisions and special provisions together.
  • Document current planning law, potential project floor area and existing permission separately.

Which plot and which plan are being referred to?

Start with a current land register extract and a site plan. A postal address may cover several plots; different provisions can also apply within a single plot. Put the cadastral municipality, plot numbers and valuation date on a cover sheet. Also indicate whether you are valuing the current condition or examining a future development.

Find the property in Vienna's information system and activate the planning-document boundary layer. The plot query allows you to download the plan and text section. Save both files with the planning-document number and retrieval date. Where several documents overlap or adjoin one another, ask which provisions actually apply to the affected part of the plot. An extract without a document number is insufficient for a transparent valuation.

Which statements belong in your zoning worksheet?

Read the symbols using the official legend appropriate to the plan. Keep your initial transcription descriptive: what actually appears in the plan, to which area does it apply, and which text provision does the number refer to? Only then turn abbreviations into a question for the planning professional. This prevents an apparently unambiguous colour from becoming an unsupported promise of development.

Why the building class does not establish saleable floor area

A plot of a given size does not become project floor area simply by multiplying it by a number of storeys. The usable geometry depends, among other things, on shape, building lines, building arrangement and applicable requirements. Stairs, circulation and technical areas also differ from the usable floor areas that can later be sold. An initial test requires a clear planning sketch with area definitions.

Ask the planning professional to disclose the starting inputs: which provisions were considered, which questions remain unresolved and which parts of the concept require exceptions or additional procedures? In the valuation, use separate rows for plot area, assumed gross floor areas and derived usable floor areas. A preliminary study remains a preliminary study; it replaces neither the complete project nor the required administrative procedure.

How should drafts and building restrictions be handled?

A published planning procedure may be relevant to the future. It must not, however, be recorded as new zoning already in force. Vienna's map also shows procedures and various building restrictions. Their specific effect must be clarified with the competent authority and, where appropriate, the project planner; the designation alone does not explain how an individual project will be treated.

For changes, maintain two separate analyses: the documented legal and existing position on the valuation date, and an explicitly conditional future scenario. In the scenario, note the next procedural step required. Additional potential usable floor area belongs in a robust calculation only once its requirements have been professionally examined and the remaining uncertainties are visible.

Which question will obtain a useful answer?

An enquiry such as 'What is my plot worth?' gives the planning authority little to work with. Better: 'For plot X in cadastral municipality Y, I have found these provisions. Which apply to the marked area, and how should special provision Z be understood?' Attach the extract, the text and your specific question about use. For project questions, add the labelled sketch.

Keep official documents, professional interpretations and your own assumptions separate in your records. The City of Vienna expressly states that no legal entitlement can be derived from the online overview. General information also does not automatically confirm that a particular design can be approved. Your result is a verifiable plot profile that allows valuation and planning to continue on the same basis.

UNDERSTAND THE PRACTICE · FICTIONAL EXAMPLE

Fictional case: one plot, two areas subject to different rules

A purely hypothetical property with no real address or actual building project. Sales particulars describe the entire area as usable for a residential project.

  1. The owner marks the plot boundary and finds that a rear area carries different planning symbols from the street-facing section.
  2. He downloads the plan and text. The planning professional must clarify which provisions apply in each area and how access would be arranged.
  3. A previously quoted project floor area is treated as an unconfirmed assumption until a verified preliminary study is available. The dossier records the unresolved question and the competent information service.
What you can take away

At first, the dossier provides no new square-metre figure. It does, however, prevent the entire plot area from being valued using the same unchecked development expectation.
